Terms of Service

1. Acceptance of Terms

By accessing or using the TrustCyber Risk & Compliance Copilot platform, website, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not access or use the Services.

2. Description of Services

TrustCyber provides a self-assessment platform that helps organisations evaluate their Microsoft security and compliance posture. The Services generate Risk Scores, Compliance Scores, findings, remediation roadmaps, and board-ready PDF reports based on self-attested responses provided by users.

Important: Assessment results are based entirely on self-attested inputs. TrustCyber does not perform technical penetration testing, live system scanning, or independent verification of your environment. Results should not be relied upon as the sole basis for security or compliance decisions.

3. Account Registration

You must create an account to access certain features of the Services. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable regulations
  • Attempt to gain unauthorised access to any part of the Services or related systems
  • Reverse-engineer, decompile, or disassemble any portion of the Services
  • Introduce malware, viruses, or other harmful code
  • Scrape, harvest, or extract data from the Services without written permission
  • Resell or sublicense the Services without a written agreement with TrustCyber
  • Submit false or misleading assessment responses with intent to deceive

5. Intellectual Property

The Services, including all software, algorithms, scoring models, report templates, and content, are owned by TrustCyber and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Services for your internal business purposes only.

Reports and outputs generated by the Services based on your assessment data are owned by you. You grant TrustCyber a limited licence to use aggregated, anonymised assessment data to improve the Services.

6. Fees and Payment

Certain features of the Services are available free of charge. Premium features require a paid subscription. Fees are described on our pricing page and are subject to change with 30 days' notice. All fees are non-refundable except as required by applicable law or as expressly stated in a separate agreement.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TRUSTCYBER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF SECURITY VULNERABILITIES.

Assessment results reflect self-attested inputs only. TrustCyber is not responsible for decisions made based solely on assessment outputs. Engage a qualified security professional for technical validation.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUSTCYBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF TRUSTCYBER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL TRUSTCYBER'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO TRUSTCYBER IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

9. Indemnification

You agree to indemnify and hold harmless TrustCyber, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

Either party may terminate these Terms at any time. TrustCyber may suspend or terminate your access immediately if you violate these Terms or engage in conduct that harms the Services or other users. Upon termination, your right to use the Services ceases. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Services. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
